Is indoor air quality (IAQ) a health and safety concern?

Indoor air quality has become a seriously important health and safety concern.

Common issues associated with IAQ include:

  1. The average person spends 90% or more time indoors, and lately more people are working from home.
  2. Newer highly efficient homes have 200% more allergens because of improperly installed ventilation systems which do not bring in fresh outside air as “make up air”.
  3. Chemical (VOC) levels can be too high due to varnishes, sealants, construction materials, carpets, laminates, glues, fiberglass, particle boards, paints, chemicals, etc.
  4. We commonly ignore and often forget to address small maintenance issues which can undoubtedly lead to much bigger and more costly repairs.
  5. If you have a hidden mold problem develop, or if you disturb mold without proper containment, airborne mold spores can easily spread to contaminate your HVAC system. The condensation in the coils, plenum and ducts provides a perfect place for mold to grow.
  6. Mold is basically a plant and has the same growth cycle as a seed. Once the dormant “seed” is introduced to water it can start to grow in 24-48 hours. If there is a food source and at least 65% humidity– it will continue to grow.
  7. Certain types of molds have the unique ability to produce highly toxic chemicals called mycotoxins, for their survival – but only when they feel threatened by bacteria or other molds. Just like our military… just because they have weapons, it doesn’t mean they are always at war.

  • For those who need the help, we also offer easy financing options and work with several mitigation companies that may be willing to absorb our costs if they are contracted for the repairs.

A Professional Protocol ensures safe, effective, and compliant mitigation or restoration. Here’s why it matters:

  • Regulatory Compliance – According to the IICRC S500 Sec 10.6.7, it is recommended that materially interested parties hire an IEP if considerations exist. We know our protocols can be greatly beneficial for all Water, Fire and Mold insurance claims. *Required for large-scale mold damage (25+ sq. ft.) in Texas.
  • Health & Safety –If followed properly the protocol will help prevent future mold growth any residual indoor air quality issues.
  • Insurance & Liability Protection – We take on the health liability of the project for the contractor and provide additional documentation of the damage and expert explanation for better claim approvals and legal protection.
  • Quality Control – A protocol outlines the proper drying, containment, cleaning and restoration that is needed for the full restoration of your project. It also includes verification and certification criteria for the repairs.

Here is some language that our client have found works well when submitting invoices to their insurance company with their request for reimbursement.

“According to the considerations listed in the IICRC S500 Section 10.6.7, I am able and encouraged to bring in an Indoor Environmental Professional (IEP) to establish the initial scope of water mitigation work and manage the health risks of my project.

…Based on the results of the hygienist’s report, the remediation contractor and I have agreed to follow the IICRC S500 generally accepted minimum industry standards which have established the proper water mitigation steps to sanitize and restore the property.

In Texas, TDLR has imposed sanctions on the homeowner, and both TDLR and the Texas Department of Insurance (TDI) now require a post-job Completion Certificate to accompany my Seller’s Disclosures if I sell the property within the next five (5) years. I trust there is no objection from you (the insurance company).

And since hiring an IEP was a reasonable incurred expense to support the damage claims, develop a Protocol and scope of work and scientifically identify health risks and habitability during the restoration. We are submitting our paid invoice for reimbursement.”

At FixAIRx, we adhere to Texas’ strict mold assessment and testing licensing requirements, ensuring compliance with the Texas Department of Licensing and Regulation (TDLR) under the Texas Mold Assessment and Remediation Rules (TMARR).

  • It is a conflict of interest in Texas for one company to perform both a Mold Assessment and Mold Remediation on the same project for the protection of the client.
  • Mold determinations (where something is or is not mold) CAN ONLY be made by a licensed Mold Assessment professional according to TDLR.
  • Exemptions to certain rules may apply to homeowners, or landlords with 10 units or less during certain maintenance activities.
  • The project must STOP Immediately if unlicensed contractors find MORE than 25 contiguous square feet of fungal damage on a project. State regulations are fully enforceable.
  • Water and Fire mitigations are currently not regulated in Texas. However, the IICRC has established generally accepted industry guidelines/standards.
    • S500 for Water Mitigation
    • S520 for Mold Remediation
    • The new S700 Fire Mitigation standards are still in the review stage.
    • The lack of State regulation does not negate the need for a Job Clearance.

1st of all Protect Yourself: If you’re unsure what to disclose, consult a real estate professional or attorney to ensure compliance with state laws.

Water & Mold Job Certification – A CMDR signed by a Licensed MAC ensures a new buyer that a damaged area was mitigated properly and was mold-free prior to build back.

CAUTION: TDLR has recently introduced sanctions against the homeowner for not providing a CMDR at the time of sale.

Mold Assessors and Remediators Penalties and Sanctions

Seller’s disclosures should include Fire Damage, Water Damage, or other Environmental hazards that may affect the health or condition of the home.

    • Any previous fire incidents, regardless of severity.
    • The extent of the damage and details of repairs.
    • Any past water intrusion issues, even if fully repaired.
    • Roof leaks, plumbing failures, drainage problems, or flooding history.
    • Insurance claims related to water damage.
    • Previous Mold Remediation
    • Termite damage, or past infestations.
    • Asbestos, lead paint, radon.
    • Structural damage or foundation issues.

We recommend to: Have your insurance broker pull a CLUE report on any new property that you are looking at purchasing – It’s like getting a Carfax, but for property, and shows up to 7 years of historical insurance claims. If there are any concerns, FixAIRx can inspect the home presale to determine any damage that could be negotiated off the sale price.

    • Please do not vacuum within the 24 hours prior.
    • Keep windows and doors closed for 24 hours prior.
    • Turn off any air purifers
    • No heavy cleaning for 24 hours prior.
    • Don’t change the HVAC filter, but if you have, save it in an a loosely closed trash bag in a climate-controlled area.
    • Pull all personal items away from both sides of walls in problem areas.
    • Create a timeline of events leading up to the current conditions.
    • Collect the contact information for all interested parties including the documentation and photos of any mitigation that has already been done.
